General Terms of Use:  Electronic Alerts and Communications

 

Acuity, A Mutual Insurance Company, offers account alerts, policy alerts, and claims texting. Account alerts are provided to you for fraud protection and when certain important changes to your account occur, such as email, password, and login ID updates. These alerts are sent automatically by email to your primary email address. You may opt-in to receive these alerts by text message and can manage alerts by visiting “My Alerts” in your online account on acuity.com.

 

In addition to account alerts, you have the option of receiving additional alerts or communications regarding policy activity, delivered by email or text message. By consenting to receive any Acuity Alerts, you agree to the delivery of such messages in the format selected (such as email or text message) to the contact point you identify. If you consent and provide us with a mobile number for Acuity Alerts, you agree to receive text messages at that number from us.

 

Acuity’s claims texting program allows a claimant to receive and send text messages about their claim. A claimant can choose to opt-in per claim. To opt into Acuity’s claims texting program, a claimant can provide verbal consent to a claims adjuster. An invitation will then be sent by text message. By providing your mobile number and consenting to text notifications, you agree Acuity, A Mutual Insurance Company, may send you texts about any current or future accounts you have with Acuity at the mobile number you provide. Acuity’s text messaging programs are governed by these Terms of Use. If you do not agree to these Terms of Use, you can, at any time, either opt-out of specific text message programs, or out of all mobile messaging. Acuity reserves the right to change these Terms of Use at any time, and, unless you opt-out, you consent to these changes by continuing to receive text communications.

 

You may discontinue account and policy alerts sent by text message as indicated below, but you will continue to receive most account alerts by email. Steps to discontinue claims texting is also indicated below.

Acuity alerts are subject to the following:

You are responsible for notifying us of any changes to your email and mobile device to which communications are sent. Please sign into your online account to modify or cancel your alert settings. For claims texting please contact your claim representative. For help with text messages, you may text "HELP" (U.S. and Canada only). If you text "STOP" from your mobile device, the command will revoke your consent to receive texts at that mobile device (although we will send a confirmation of your opt-out), but will not revoke any other consent you may have provided us.

 

Communications may contain your name and information about your policy, or claim. Depending upon the communication, information pertaining to claims status, transactions or payment due dates may be included. Your full credit or debit card number or bank account number will not be included. Anyone with access to your email or mobile device may be able to access the contents of the communication. It is your responsibility to secure these devices, protect your username(s) and password(s), and provide timely information about contact changes in order to protect the confidentiality of this information. You consent to any disclosures by Acuity, A Mutual Insurance Company, that may occur if you do not take appropriate steps to prevent access to your information by unauthorized persons.

 

We make every effort to ensure that this service is provided without interruption, but we reserve the right, in our sole discretion, without obligation and notice requirement, to change, improve or correct text messages and to suspend text messages for scheduled or unscheduled maintenance, upgrades, improvements or corrections. Acuity cannot and does not guarantee continuous, uninterrupted or secure text message services. Acuity cannot guarantee that text messaging services provided through your wireless carrier will be delivered, and we will not be liable for delayed or undelivered messages. The mobile carriers are not liable to you for delayed or undelivered messages.

 

It is your responsibility to determine if your mobile service provider supports text messaging and if your mobile device is capable of receiving text messages. Our text messages are subject to the terms and conditions of your agreement(s) with your mobile device carrier, including any standard messaging rates or other carrier charges that may apply. You are responsible for any fees imposed by your mobile device carrier of any kind whatsoever. Acuity may discontinue any text messages at any time without prior notice to you, subject to applicable law. Message and data rates may apply.
